SHELTER RESERVATION CONTRACT:
By your agreement with these terms and conditions, you represent that you are 21 years or older, you will be present during your stay and that you are authorized to make this reservation on behalf of the group you have listed. You agree to assume full responsibility for the acts, negligence or omissions of the members of your group while utilizing said facilities. Additionally, you agree that you have read and understand the CANCELLATION and REFUND POLICIES concerning this reservation and have also read and understand the SHELTER RENTAL RULES information.
You are reserving a facility from the Clay County Conservation Board. All COUNTY PARK RULES and STATE LAWS are enforced. RULES and REGULATIONS may be found in “Related Items” at the bottom of the Clay County home page on this website. Contact the Office at 712-262-2187 or at 420 10th Avenue SE, Spencer, IA 51301 if you have questions concerning park rules, policies or special requests. Park Staff have the authority to refuse rental privileges and rescind any and all rental permits for cause.
Failure to clean up the facility or surrounding area as outlined, or failure to comply with park rules or state laws may result in enforcement action. A cleaning fee of a minimum of $100.00 will be charged if the facilityis not left in the condition you received it. Clay County Conservation Board may take any legal action necessary for non-compliance of any rules and regulations or to recover damages to county property.
MODIFICATION, CANCELLATION AND REFUND POLICIES:
Please consider these policies prior to purchasing your facility reservation.
MODIFICATION POLICY:
· Requests for any modification to an existing reservation must be made at least thirty (30) days prior to the original reservation date and by the person whose name is on the reservation contract.
· If the request is for a date change, the new date must be within twelve months of the existing date. A date change must be used for the same facility in the same Clay County Park.
· If the modification is a change in facility and the cost of the facility to which you are changing to rents at a higher fee, you will be asked to pay the difference in rental cost. If the cost of the facility to which you are changing to rents at a lesser fee, renter forfeits the difference in rental cost.
· A reservation holder has only ONE opportunity to reschedule their original reservation.
· Any modifications you make to an existing reservation will be assessed a $10 change fee.
· Facilities with canceled reservations will be reopened for reservation for the date of a cancellation.
· All reservation modifications must be made by calling the Conservation Office at (712) 262-2187.
CANCELLATION POLICY:
· Please understand reservations are not transferable and at the time of booking your reservation you immediately prohibit others from reserving and utilizing the facility.
· Should you decide to cancel your reservation, you must call the Clay County Conservation Board office at 712-262-2187. Cancellations cannot be done on the website.
· Cancellations must be done a minimum of 7 days prior to the date on which the facility is reserved to qualify for a partial refund (see refund policy).
· You will forfeit 100% of all on-line processing fees paid.
REFUND POLICY:
SHELTER RENTAL RULES:
CHECK-IN TIME: After 11:00 a.m.
CHECK-OUT TIME: Before 10:30 p.m.
SHELTER ACCESS: The door is equipped with a keyless entry pad. The park ranger will activate the knob with the code selected at reservation. It is your responsibility to ensure the door(s) and windows are shut and locked upon your departure.
CLEAN-UP: You are required to clean up the facility and grounds and return them to the condition you received them. A cleaning list is posted inside the shelter. A cleaning fee of a minimum of $100.00 will be charged if the facility is not left in the condition you received it. Plan to have your facility cleaned and people departed prior to the scheduled 10:30 p.m. checkout time. Paper towels, trash bags, broom, and cleaning agents will be supplied in the shelter to assist you in your cleanup duties.
GARBAGE: The burning of trash is toxic to others, please DO NOT BURN TRASH. All refuse must be placed in provided dumpsters. Be sure to pick up your other small trash like straws, straw wrappers, can rings, etc., that could also pose a hazard to the wildlife..
PERSONAL ITEMS: We are not responsible for the return of any belongings you have left in the shelter upon your departure.
SPEED LIMIT in the Park is 5 MPH.
VISITORS: All non-registered visitors must leave the Park by 10:30 p.m.
SMOKING: Clay County is a smoke-free environment. Smoking is prohibited in all buildings.
PETS: Pets are not allowed in rental facility.
PARKING: Parking is confined to designated parking areas. No parking or driving off roadways.
DIRECTIONAL SIGNS & DECORATIONS: Temporary, free standing directional signs are allowed and are not to be attached to park structures, trees, furniture, sign posts or other facilities. Decorations are allowed as long as they are free standing or not affixed in any manner that would damage a facility (NO tape, tacks, nails, staples, etc.), the use of a no-stick adhesive is recommended. Special care should be taken with balloons so that they do not escape and possibly injure wildlife. ALL signs and decorations must be removed upon check-out.
ALCOHOLIC BEVERAGES: You will not charge a fee for the consumption of alcoholic beverages on the premises and you will not serve alcoholic beverages to any intoxicated persons. You will assume full responsibility for the care and well-being of all social guests of yours while on County property, and you will also assume full responsibility for your social guests that consume alcoholic beverages at this conservation area.
You will agree to indemnify and hold harmless Clay County, the Clay County Conservation Board, and its employees from any and all liability that may arise which is proximately caused by the consumption of alcoholic beverages on County premises by you, your invitees, or your social guests whether any such injury occurs on County property or otherwise.
Keg beer is not permitted in the Park.
FIREWOOD: Out of State Firewood is prohibited.
CLAY COUNTY CONSERVATION RESERVES THE RIGHT TO ENTER THE SHELTER AT ANY TIME IN THE CASE OF EMERGENCY, MAINTENANCE, NON-COMPLIANT RENTAL ISSUES OR SECURITY PROBLEMS.
IN CASE OF AN EMERGENCY, CONTACT THE CLAY COUNTY DISPATCH AT 712-262-2151 OR 911. They will contact the Ranger on duty.
